What are the steps to obtain asylum in Colorado?

On Behalf of | Apr 9, 2025 | Immigration Law |

If you fear returning to your country of origin, seeking asylum offers a legal way to stay in the United States. Federal immigration law controls the process, but living in Colorado means you’ll also face local logistics and procedures. Learn each step to build a strong application.

Determine your eligibility

To qualify for asylum, you must prove that going back to your home country exposes you to a real risk of persecution. That persecution must relate to your race, religion, nationality, political opinion, or membership in a particular social group. You need to file your application within one year of entering the United States, unless you can prove changed conditions or exceptional situations.

Complete and submit your application

File Form I-589, the Application for Asylum and for Withholding of Removal. You won’t need to pay a filing fee. Include a detailed personal affidavit, supporting evidence, and valid identification documents. Review every section carefully. Mistakes or missing information can delay or weaken your case.

Attend your biometrics appointment

After you file your application, immigration officials will send you a notice for a biometrics appointment. During this visit, officials will collect your fingerprints and photos to run background checks. Attend this appointment on the scheduled day. Missing it can seriously damage your case.

Participate in your interview or court hearing

If you apply affirmatively, attend an interview at a United States Citizenship and Immigration Services (USCIS) office. If you apply defensively, appear in court before an immigration judge. Bring original documents and practice your responses to likely questions. Strong preparation helps you present a clear and consistent case.

Await the decision

Officers or judges may take several months or even years to decide your case. After 150 days pass from your application date, you can apply for a work permit. Check your case status regularly and show up for every appointment or request.
